Chloe Cole Scores Early Win at Appellate Court

Chloe Cole scored an important early victory in her pursuit of justice. On Friday, the Court of Appeal for California’s Third Appellate District in San Joaquin affirmed the trial court’s ruling that Chloe’s case is headed for a public trial, not private arbitration.

Whether a case is bound to arbitration is a matter of contract. Neither the trial court or appellate court could find evidence of Chloe, or her mother, consenting to arbitration.

The trial court found there was no evidence that Chloe agreed to binding arbitration and concluded there was no reason her case for medical negligence against Kaiser and several physicians wouldn’t go to trial. Kaiser then petitioned for reconsideration…and lost that motion. And on Friday, a California appellate court affirmed the trial court’s ruling.

This means Chloe Cole — one of America’s most courageous voices speaking out against the harms of gender ideology — will finally get her day in court.

“They tried everything they could to stop me from holding them accountable and tried to bury my case under closed-door arbitration, and it still wasn’t enough,” said Chloe Cole. “Now, the whole world is going to see their wrongdoing, and a whole movement of betrayed children and families is going to take them down. See you in court, Kaiser!”

“Today’s decision is tremendous news. Chloe will not be silenced. She will have her day in court, and the truth will come out,” said Mark Trammell, CEO of the Center for American Liberty.
