Center for American Liberty Sues Governor Ige for Unconstitutional COVID-19 Emergency Orders
The Center for American Liberty’s in conjunction with The Dhillon Law Group, and attorney James Hochberg on behalf of plaintiffs, filed a lawsuit against Governor Ige in federal court for unconstitutional orders related to the COVID-19 pandemic.
Ige issued the emergency proclamation for COVID-19 on March 4 and continues to operate under it, despite Hawaiian law limiting a governor’s emergency powers to 60 days. Additionally, Hawaii law stipulates that Ige can only order the quarantine of those known to have a disease or suspected to have it, not a blanket order effectively imprisoning all mainland Americans who arrive to the islands.
“Governor Ige is depriving Hawaiians and those living on the mainland of their constitutional right to travel, due process, and equal protection rights by mandating that everyone who comes to Hawaii be isolated in quarantine for 14 days,” said Harmeet K. Dhillon, CEO of the Center for American Liberty. “The governor has flagrantly disregarded the United States Constitution with ten successive orders with seemingly no consideration of the Constitutional limits of his powers.”
The lawsuit alleges that Ige’s unconstitutional order deprives plaintiffs Holly and Aaron Carmichael the ability to stay in their Maui condo, Oahu resident Brooke McGowan from visiting her daughter and grandmother who live on the mainland, and Russell Hirsch the ability to tend to his house and farm in Kailua and Hilo, respectfully.
“This litigation was filed because Governor Ige has exceeded his authority with his COVID response,” Hochberg said. “Most of the Plaintiffs own property in Hawaii and are precluded from tending to their properties due to the Governor’s unlawful violations of the Plaintiffs’ civil right to interstate travel. One cannot visit her family on the mainland during times of important need. Governor Ige has unlawfully continued his lock-down of our economy.”
